Maxim Burak is a Partner at GRATA International in Astana. Maxim got a lot of experience and deep knowledge in the oil and gas industry, subsoil use and corporate transactions.

Maxim’s experience includes obtaining the refusal of the state from the priority right to purchase the alienated subsoil use rights in mergers and acquisitions, consulting subsoil users on local content, implementation of full legal support additional agreements to contracts for subsoil use, in particular regarding the extension of the exploration period and the percentages of Kazakhstani content and implementation Due Diligence contracts on subsoil use.

  • Advising a major Kazakh construction company regarding the use of funding in the construction of real estate properties within the framework of the international exhibition EXPO-2017;
  • Advising a group of major petrochemical companies with participation of both Kazakhstani and international state and private companies, in connection with construction of a petrochemical plant in Western Kazakhstan, including drafting EPC contracts;
  • Advising one of the major national companies in connection with the acquisition of several immovable property objects intended to prevent damage from oil spills;
  • Advising a big Russian production company in connection with the acquisition of warehouses in Kazakhstan;
  • Advising Kazakhstani logistic company with respect to attracting financing from institutional investors;
  • Providing legal services on subsoil use issues to one of the largest mining holdings in Eurasia in connection with its restructuring;
  • Providing detailed advice and legal opinions on transfer of subsoil use rights;
  • Providing detailed advice on local content issues, including applicability of amendments in local content legislation;
  • Consultations in relation to issues of internal safety training and studies;
  • Defending interests of a big production company in employment case in the Supreme Court;
  • Providing consultations with regard to order of internal company investigation in the view of employment law;
  • Maintaining the process of introducing amendments to 6 subsoil use contracts. Negotiations with the competent authorities;
  • Obtaining approval for transactions with shares in subsoil users and subsoil use right;
  • Representation of big mining companies’ interests in the governmental bodies;
  • Work with the authorized body in the sphere of geology in order to get reports on return of contract territory approved;
  • Providing legal consultations to governmental bodies with regard to draft amendments to legislation;
  • Providing detailed advice on decrease of local content obligations under subsoil use contracts.
